Art. 2027. No annuity shall be claimed without first proving the existence of the person upon whose life the annuity is constituted.

What this article means

The closing article of the chapter on life annuity, immediately before Compromises and Arbitrations begins. No annuity payment may be claimed without first proving that the person on whose life the annuity was constituted is still living. Since a life annuity's very existence depends on that person's continued life, this is simply the evidentiary consequence of the arrangement described in the preceding articles — the claimant carries the burden of proving the fact the whole obligation turns on.
