Where to File Your Case in Metro Manila

Filing in the wrong forum gets a case dismissed after months of work, and it is one of the most common and most avoidable errors. This sets out how venue is determined for each type of case across Metro Manila.

First: venue is not the same as jurisdiction

JURISDICTION is the court's power to hear the kind of case at all. It is conferred by law, cannot be given by the parties' agreement, and its absence makes the judgment VOID — it can be raised at any stage. VENUE is merely the place of trial. In civil cases it is largely for the parties' convenience, it can be waived, and it must be objected to early or the objection is lost.

The practical consequence: a case filed in a court that lacks jurisdiction is a wasted year. A case filed in the wrong venue may survive if nobody objects in time. Do not rely on that.

Family cases: nullity, annulment, legal separation

Filed with the FAMILY COURT of the province or city where the petitioner OR the respondent has resided for at least six (6) months before filing. Where the respondent is a non-resident, the petitioner may elect to file where the respondent may be found in the Philippines.

The three points people get wrong: it follows RESIDENCE, not the place of the wedding; it follows residence, not where you work; and the six months must be alleged and proved, so assemble the documentary proof before filing. Petitions for custody, support, adoption, and protection orders under RA 9262 likewise go to the Family Court, generally where the petitioner or the child resides.

Criminal cases

Venue in criminal cases is jurisdictional — unlike civil venue, it cannot be waived. The case is filed where the offense was committed, or where any of its essential ingredients took place. Which court depends on the penalty prescribed: the Metropolitan Trial Court for the lighter offenses within its statutory limit, the Regional Trial Court above it.

Special rules override this in defined cases: cyber-related offenses and libel have their own venue provisions, and offenses by public officers within the Sandiganbayan's jurisdiction go there regardless of where committed. Complaints generally begin at the Office of the City Prosecutor of the city where the offense occurred.

Property and possession

REAL ACTIONS — those affecting title to or possession of real property — are filed where the property is located. Which court depends on the action and the assessed value:

Money claims and personal actions

PERSONAL ACTIONS — collection of a sum of money, damages, breach of contract — are filed where the plaintiff OR the defendant resides, at the plaintiff's election. For a juridical person, residence means its principal place of business as stated in its articles.

Two qualifications matter. A valid written stipulation on exclusive venue in the contract controls, which is why venue clauses in loan and lease documents are worth reading before signing. And SMALL CLAIMS — money claims within the threshold the Rules set — go to the first level courts under a streamlined procedure where lawyers do not appear for the parties at the hearing and the decision is final and unappealable.

Settlement of an estate

Where the decedent was a Philippine resident, the estate is settled in the Regional Trial Court of the province or city where they resided at the time of death — not where the heirs live, and not where the property happens to be. Where the decedent was a non-resident, it is filed where any of the estate's property is located. Extrajudicial settlement (no will, no debts, heirs in agreement) is done by public instrument filed with the Register of Deeds, with publication once a week for three consecutive weeks.

Labor cases

Nearly all begin with a Request for Assistance under SEnA at the DOLE field office with jurisdiction over the workplace — not over the employee's home. If unresolved after the mandatory conciliation period, the case is referred:

Deadlines: money claims prescribe in THREE (3) YEARS, illegal dismissal in FOUR (4).

Specialised forums that are easy to miss

Barangay conciliation comes first — or the case is dismissed

Under the Katarungang Pambarangay rules in the Local Government Code, disputes between individuals residing in the same city or municipality must generally go through barangay conciliation first. Filing in court without the CERTIFICATION TO FILE ACTION is a ground for dismissal for failure to comply with a condition precedent.

The main exceptions, where you may go straight to court: where one party is the government or a public officer acting in official capacity; where the parties reside in different cities or municipalities (subject to the adjoining-barangay qualification); where the dispute involves real property located in different cities; offenses with no private offended party, or punishable by imprisonment above the statutory limit; where the action is coupled with a provisional remedy such as a preliminary injunction, attachment, or support pendente lite; and cases requiring urgent legal action.

Venue and jurisdiction turn on facts that are easy to state wrongly — where someone actually resides, what a property is assessed at, whether a claim includes reinstatement. Those determinations are worth confirming before filing rather than after a motion to dismiss.
