Settling a Taguig and BGC estate
Property does not pass to the heirs until the estate is settled. Where there is no will, the heirs agree, and there are no debts, it is done by extrajudicial settlement — a notarized deed, published once a week for three consecutive weeks in a Taguig and BGC newspaper of general circulation. Otherwise it is settled in court, before the Regional Trial Court of Taguig of the deceased’s residence. Taguig and BGC estates tend to be newer condominium holdings, where the title and developer records are recent but valuations are high.
The estate tax must be paid first
No title moves until the estate tax is settled. It is a flat six percent of the net estate, filed with the BIR Revenue District Office that covered the deceased’s residence, and due within one year of death. Deductions include a standard five million pesos and the family home up to ten million. The estate tax amnesty under RA 11956 has lapsed, so estates now settle under the regular rules, with surcharge and interest on late payment.
Transferring the titles
Once the BIR issues the eCAR, the titles are transferred at the Registry of Deeds of Taguig and the tax declarations updated at the city assessor. Only then can an inherited property be sold or partitioned among the heirs.
