Settling a Parañaque estate
Property does not pass to the heirs until the estate is settled. Where there is no will, the heirs agree, and there are no debts, it is done by extrajudicial settlement — a notarized deed, published once a week for three consecutive weeks. Otherwise it is settled in court, before the Regional Trial Court of Parañaque. Parañaque is an airport-adjacent city of established villages and reclamation-area developments. Parañaque estates often have heirs working abroad, so the settlement's signatures may need apostilled or consularized documents.
The estate tax must be paid first
No title moves until the estate tax is settled. It is a flat six percent of the net estate, filed with the BIR Revenue District Office covering Parañaque, and due within one year of death. Deductions include a standard five million pesos and the family home up to ten million. The estate tax amnesty under RA 11956 has lapsed, so estates now settle under the regular rules. Once the BIR issues the eCAR, titles are transferred at the Registry of Deeds of Parañaque.
