Illegal Dismissal & NLRC Money Claims

Losing your job does not always mean the dismissal was lawful. A dismissal that lacks a valid cause or the required due process is illegal, and the law gives you real remedies. This is when a dismissal is unlawful, what you can recover, and how the case works.

A lawful dismissal needs both a cause and due process

An employer cannot dismiss at will. A valid termination requires both a lawful ground and the correct procedure. Just causes relate to the employee's own conduct — serious misconduct, willful disobedience, gross neglect — and require the two-notice rule: a notice to explain, a real chance to be heard, and a notice of decision. Authorized causes are business reasons such as redundancy or retrenchment and require thirty days' written notice to the employee and to DOLE, plus separation pay. A dismissal that fails on either the cause or the process is illegal.

Constructive dismissal counts too: when a demotion, a deep pay cut, or harassment makes staying unbearable and forces you to resign, the law treats it as a dismissal by the employer.

What you can recover

The standard remedy for illegal dismissal is reinstatement without loss of seniority plus full backwages from the dismissal until reinstatement. Where reinstatement is no longer viable — a closed position or genuinely strained relations — the court awards separation pay in lieu of reinstatement plus backwages. On top of that you may recover unpaid wages, statutory benefits, and, in bad-faith cases, damages and attorney's fees.

Where you file, and the deadlines that end claims

Most disputes go first through the DOLE Single Entry Approach (SEnA), a mandatory thirty-day conciliation, before a formal complaint is docketed with the Labor Arbiter at the NLRC. The deadlines are strict: an illegal dismissal action prescribes in four years, money claims in three years from when each accrued, and unfair labor practice in one year. The clock does not stop while you wait for the employer to reconsider.

Was my dismissal illegal?

A dismissal is illegal if it lacks a valid cause or the required due process. Will I be reinstated or get separation pay?

You do not choose freely; it depends on the circumstances the tribunal finds.

How much backwages can I claim?

Full backwages run from the date of your illegal dismissal until actual reinstatement or, where separation pay is awarded instead, until the decision becomes final. They cover your basic salary plus regular allowances and benefits you would have received, without deduction for income you earned elsewhere in the meantime.

How long do I have to file an illegal dismissal case?

Four years from the date of dismissal for the illegal dismissal itself, three years for money claims arising from employment, and one year for unfair labor practice. These periods are strict, so filing promptly matters; negotiating with the employer does not stop the clock.

Do I have to go through DOLE before the NLRC?

In most cases yes. The Single Entry Approach requires a thirty-day conciliation-mediation before the dispute can proceed to a formal complaint with the Labor Arbiter. Many cases settle there, and the arbiter will check that this step was taken.
