Text of the provision

Art. 2046. The appointment of arbitrators and the procedure for arbitration shall be governed by the provisions of such rules of court as the Supreme Court shall promulgate.

(n)

Civil Code of the Philippines, Republic Act No. 386, approved June 18, 1949, effective August 30, 1950. Reproduced in full; verified verbatim against the LawPhil and ChanRobles renderings and the Official Gazette, all three of which agree word for word.

What this article means

The closing article of the Compromises and Arbitrations title, immediately before Guaranty begins. The appointment of arbitrators and the procedure for arbitration is left to whatever rules of court the Supreme Court promulgates, rather than fixed in the Civil Code itself. Arbitration in the Philippines today is chiefly governed by the later Republic Act No. 9285 (the Alternative Dispute Resolution Act of 2004) and the Special ADR Rules the Supreme Court issued under it, which is exactly the kind of Court-promulgated framework this article contemplated.
