Text of the provision

Art. 1637. The provisions of this Title are subject to the rules laid down by the Mortgage Law and the Land Registration Law with regard to immovable property.

What this article means

The closing article of the entire Sales title, immediately before Barter begins. It is a pointer provision: the rules in this Title (Sales) do not displace the separate body of law governing how immovable property is registered and encumbered — at the time of enactment, the (Spanish) Mortgage Law and the Land Registration Act (Act No. 496). Both have since been superseded by later legislation (Presidential Decree No. 1529, the Property Registration Decree, and the discontinuance of the old Spanish Mortgage Law registration system under Presidential Decree No. 892), but the pointer itself still functions exactly as written: a sale of registered land must still satisfy the Torrens registration formalities under the law now occupying that field, on top of whatever the Sales title requires.
